Ohio Assault Statutes: Elements & Penalties

Understanding what the prosecution must prove, and what penalties attach to each charge, is the starting point for any defense strategy.

Assault (ORC 2903.13)

The prosecution must prove the defendant knowingly caused or attempted to cause physical harm to another person, or recklessly caused serious physical harm. In most circumstances, this is a first-degree misdemeanor: up to 180 days in jail and a fine up to $1,000. The charge becomes a felony when the victim is a protected person, including a peace officer, firefighter, emergency medical worker, teacher, school employee or volunteer, or a functionally impaired person in the offender’s care.

Negligent Assault (ORC 2903.14)

The prosecution must prove the defendant negligently caused physical harm by means of a deadly weapon or dangerous ordnance. This is a third-degree misdemeanor, carrying up to 60 days in jail and a fine up to $500.

Aggravated Assault (ORC 2903.12)

The same core conduct as felonious assault, but committed under sudden passion or a sudden fit of rage brought on by the victim’s provocative acts. That emotional trigger reduces the charge from a second-degree to a fourth-degree felony, with significantly lower potential penalties.

Felonious Assault (ORC 2903.11)

The prosecution must prove the defendant knowingly caused serious physical harm, or knowingly caused or attempted to cause physical harm by means of a deadly weapon or dangerous ordnance. This is a second-degree felony with a prison range of 2 to 8 years and a fine up to $15,000. Because felonious assault is an offense of violence, Ohio’s Reagan Tokes Law applies: the court imposes a minimum and maximum prison term, and the defendant may be held beyond the minimum depending on conduct during incarceration. If the victim is a peace officer, the charge elevates to a first-degree felony.

Collateral Consequences of an Assault Conviction
