This wasn’t an ordinary case. Crystal came to us facing an OVI charge. Our role was to question every detail and defend her rights at every turn. As Attorney Beau Cross noted, “This case started off as an OVI arrest. We filed a Motion to Suppress, and I began my questioning to the officer with, ‘Is there anything you want to add, change, or delete from your report?’ From there, the officer admitted to mistakes, then the State stipulated that some of the field sobriety testing was compromised and should be suppressed. The Judge still found there was probable cause to arrest, but stated ‘I was surprised at how thin the probable cause standard is.’”
Thanks to this effort, the hearing revealed issues that worked in Crystal’s favor. Afterward, at the next pretrial, the judge told the State to consider settling. The State followed that advice, and Crystal’s OVI charge was reduced.
